(MANCHESTER, NH) (August 18, 2020) --- New Hampshire Republican U. S. Senate candidate Andy Martin will hold a Manchester news conference Tuesday, August 18th to charge that based on the felony accusations lodged by two former justices of the Colorado Supreme Court and others, Bryant “Porky” Messner is “a de facto fugitive from Colorado justice and must return to Colorado to face expected criminal charges,” (please see link [1] below). Andy previously demanded that Messner withdraw as a senate candidate due to Messner’s latest financial scandal with his “Messner Foundation.”

Andy says that despite spreading millions of dollars around to buy loyalty from New Hampshire Republican leaders and corrupt media, the Messner campaign has become a farce.

“And he is also a painfully lousy candidate,” says Andy. “‘Porky’s’ TV commercials are the worst I have seen in over 40 years. In addition to being an accused felon and fraud, he’s a loser. Shaheen’s commercials are much better produced and, in the absence of a countervailing candidate’s attack, more believable.

“The Messner campaign is taking on a circus-like atmosphere. Democratic college students are now out recruiting ‘victims’ of Messner’s foundation fraud,” (please see link [2] below). What are the chances he gets indicted?”

Andy charged on August 2^nd that “Messner’s foundation is a scam,” (please see link [1] again for details). Messner also has a drunk driving conviction in Colorado that he has not addressed. “We’ve got lots more scandals to disclose during the next three weeks. This has got to be the biggest embarrassment to the New Hampshire Republican Party. New Hampshire media are also in disgrace because they have parroted Messner’s bromides without any analysis of his past history in Colorado. That’s not journalism. ‘Ask no questions’ Republicans took millions of Messner’s dollars, and they are now stuck with a dead duck,” Andy charges.

“President Trump has also endorsed Messner, another scandal that we will be addressing in the next few days. Trump was victimized by his own inner circle.”

Andy says that this week he is “ramping up” his attacks on his corrupt and/or incompetent primary rivals, as well as corrupt officials at the University of New Hampshire and Hearst Family employees that are trying to rig the primary in favor of Messner.

“Fasten your seat belts,” Andy says. “New Hampshire, home of the novel “Peyton Place,’ is about to have the bark stripped off its slimy state university and corrupt New York-owned Hearst TV station WMUR-TV. This is the most exciting primary election in the country: corruption fighter (Andy) meets crooks and incompetents (Messner and Bolduc) and battles the bad guys. Voters in New Hampshire are being victimized by their mendacious media and corrupt state university. But I am coming to the rescue with the facts and the truth about New Hampshire politics. It stinks.”

Dear Granite State Voter:

Sixteen years ago, I created the anti-Obama “Birther” movement. Only I wasn’t a Birther myself. My scholarly research into Obama’s origins began with news conferences that exposed Obama’s “life story” as largely a fraud (please see link [1] below). Sixteen years later, The Atlantic Magazine again confirmed my creation of the Birther movement (please see link [2] below).

What I began as fact-based investigation took on an independent life as people like Donald Trump appropriated my research and fictionalized it for their own purposes. I never suggested Obama was born in Kenya. That theory was nonsense. I never suggested Obama was born anywhere but Honolulu. There was no credible evidence to support the claim. Nevertheless, the media went on accusing me of being the founder of the Birther movement.

In 2018, Adam Sexton of WMUR-TV, who had over a decade to research the question he posed to me in a televised debate, falsely accused me of creating doubt about where Obama was born. Sexton was either lying or incompetent. I had never questioned where Obama was born. I just wanted a copy of the birth certificate.

I remember once in Hawai’i having a phone call with one of my readers. I told her my scholarly integrity prevented me from lying about the facts of Obama’s origins. She laughed and said, “We love you Andy because you stick to the facts and tell the truth. But then we add a few ornaments to suit our own purposes.” Such is life. We own our own words; but we do not own what others make of them.

The focus of my inquiry was always seeking access to examine Obama’s original birth certificate (please see link [3] below for the original 2008 court order).

What I did accomplish, at a time when little was known about Obama’s origins, and when most of his own “autobiography” was fiction, was to relentlessly focus on Obama’s murky family history. In that I succeeded admirably. The Birther movement has become in the minds of left-wing media the largest “conspiracy theory” in history. There was no conspiracy on my part; just the facts and evidence.

I did not have the sheer media power to force Obama to release what Obama claimed was his original birth certificate. Donald Trump did force Obama’s hand.

Even after Obama was elected, I continued to organize opposition to Obama taking office, triggering challenges to his formal election in the Electoral College. I am still fighting to expose Obama because he remains the greatest political fraud in American history.

So, what does all of this have to do with Kamala Harris in 2020? The same legal issues that I wrote about in 2007-2008, raising questions about the “Natural Born Citizen Clause” in the Constitution, apply as much to Harris as they did to Obama. My constitutional analysis is not a conspiracy theory and it is not a racist attack. My scholarly research was and is firmly grounded in American constitutional history.

And so, more than a decade later, I am repeating what I wrote about Obama because it clearly applies to Kamala Harris and – surprise – even President Trump himself.

Please bear with me. The concepts are a little complicated but I will try to make them understandable.

1. Why was the “National Born Citizen Clause” put in the Constitution?

America today is the great global colossus. Because most of us are ignorant about American history, we have no idea what a puny, vulnerable nation the “United States of America” was in 1789. While popular history focuses on colonists fighting British forces and King George of England, much of the American-born and immigrant stock was of German origin, particularly once you left the coastal cities. The drafters of the Constitution, well-aware that German-speaking Americans were prevalent, worried that a German Prince would come to America and father a child to establish Germanic hegemony of the new nation.

2. Did the term “natural born citizen” have a specific meaning in 1789?

Section 1 of Article 2 of the Constitution requires that a president or vice president be a “natural born citizen.” The term is not defined, so we have to look at constitutional law and theory in 1789 to determine if the term had an understood meaning. It did.

We start with the canon of constitutional construction that in constitutional documents, all words have meaning; words are not inserted in a constitution without an intended purpose. The NBC Clause was intentionally inserted in the Constitution.

Under commonly understood legal theory in 1789, a natural born citizen had both parents born in the United States. Being born yourself in the U. S. made you a “citizen.” But you were “natural born,” and therefore eligible to serve as president, only if both of your parents had also been born in the U. S. That is how the founders intended to prevent foreigners from coming to the U. S. and procreating a baby who would then be eligible for the presidency. The “both parents had to be born in the U. S.” clause was intended to be a significant barrier to eligibility.

3. Did the Fourteenth Amendment silently amend the Constitution?

The Fourteenth Amendment and the Supreme Court’s “Citizenship Cases” gave the Fourteenth Amendment a broad sweep. But did the Congress that drafted the Fourteenth Amendment intend to nullify the “natural born citizen” requirement of Article 2, Section 1 of the Constitution? As a conservative, I would say “no.” The NBC Clause is still in effect, albeit not enforced. The Fourteenth Amendment makes you a “citizen” if you were born in the U. S. but it does not make you a “natural born citizen” under the language and usage in 1789.

4. Is the Natural Born Citizen Clause enforceable?

If the NBC Clause is still there, can anyone enforce it? Probably not. In 2008 there were lots of lawsuits seeking to litigate NBC Clause issues. All of them failed. The courts have created a “wall” around the NBC Clause, to the point that no one has a right to go to court and enforce it.

5. So is Kamala a natural born citizen?

If you apply the term as it was adopted and understood in 1789, no, she is not. Both of her parents were born outside the United States.

But what if one parent was born in the United States? President Trump’s mother was born in Scotland; does his citizenship fail because he is only 50% natural born (through his father)? Obama’s mother was clearly born in the U. S. Did his 50% natural born status satisfy the requirement? In both cases, there is no legal process to challenge their eligibility.

6. Is the Natural Born Citizen Clause debate racist?

Not at all. Over the decades, many potential and actual presidential candidates have come under scrutiny because of where they were born or their parentage. As noted above, the NBC Clause was originally intended to block German nobility from coming to the U. S. and trying to create a German state or substate. The Founders in 1789 had no intent to bar African-Americans through the NBC Clause. So, the shrill complaints of guests on MSNBC and CNN, screaming that any invocation of the NBC Clause is “racist,” are unfounded.

President Obama served 8 years in office despite the fact his alleged father was a foreigner. I do not think that the Scottish birth of President Trump’s mother should cause him to lose sleep he will be barred from office. And Kamala Harris can probably rest easy that despite the renewed debate over the NBC Clause, she will not be blocked from taking the oath of office if she and Biden win.

I hope I have taken a complex constitutional issue and made it understandable. You may disagree with me, but at least you understand the law and history of the NBC Clause and you can judge for yourself.

“The Washington Post has done an exhaustive investigation of the so-called ‘Messner Foundation’” Andy says. “Messner’s foundation is a scam. (Please see link [1] below). Over the past several months we have accumulated a series of scandals about Messner, large and small, including his drunk driving conviction which I discussed several days ago (please see link [2] below).

“Why Messner thinks he can be a credible opponent for Jeanne Shaheen is beyond me. Perhaps because all of his financial trickery has made him a rich man, with a $45 million fortune, he thinks he can buy people in New Hampshire. But why did he come to New Hampshire to run when his business and home are in Colorado? Wyoming would have been a lot closer place for him to run.

“Is scandal-plagued Messner the candidate who New Hampshire Republicans really believe can defeat Shaheen? Shaheen has been wiping out Republican candidates for over 30 years. With all of his scams and scandals, Messner is simply not a credible candidate for U. S. Senate. Democrats are salivating at the prospect that a buffoon like Messner would be their senate opponent.

“Rather than go through the Washington Post story line by line, I think Republicans should click on the link below and read the facts for themselves.

“In closing, I have two major opponents, both of whom have shown they lack the experience to mount a serious campaign against Shaheen. Each has been found guilty of deceptive activity. They have no experience and they lack the ability to run against a well-entrenched incumbent. Bolduc and Messner are delusional.

“People know where I have been for the last decade, not in Colorado but right here in New Hampshire fighting corruption and working to enhance and Rebuild the Republican Party. I may not be everyone’s ‘favorite,’ but I do have the experience to run a serious campaign. The Chicago Tribune once called me an ‘absolutely brilliant campaigner,’ and I have only improved since then.

“Messner’s candidacy is a joke. Take away his $45 million and it would be laughable for him to run for senator from New Hampshire. Republicans say they want to defeat Shaheen. Then why are they encouraging a Colorado huckster to represent them? Why don’t they consider me, an experienced candidate whom everyone acknowledges as a hard-nosed campaigner with the tools to attack Shaheen relentlessly?

“Why is it that the most pertinent reporting about New Hampshire political scandals is coming out of Washington, DC? New Hampshire’s fake news media (Kevin Landrigan and John DiStaso) just print handouts from the candidates. They have not done any investigation of Bolduc or Messner.

“I can promise my GOP friends that August is going to be very ‘hot’ for my primary opponents. We have more scandals and investigations that even we can publish in five weeks. But we will bring the truth to the Granite State, even if the local media refuse to do so.

“After the latest embarrassment of the ‘Messner Foundation,’ how can any Republican in good faith and with a straight face continue to endorse Messner’s candidacy?” Andy asks.

Dear Tom:

I want to be among the many who will welcome you to New Hampshire on Friday. The Hillsborough County Republicans are to be congratulated for bringing you to Nashua.

As I was writing this letter you popped up on Fox News exposing the so-called “1619 Project” boondoggle of the New York Times. That the trashy misrepresentation of our history, 1619, won a Pulitzer Prize shows how deeply our nation has been degraded. No tax dollars for the 1619 Project!

New Hampshire is evenly balanced between Republicans, Democrats and independents. In my opinion, the state is now trending Democratic although not everyone agrees with me. The Republican Party is a work in progress. I try especially hard to encourage and motivate Young Republicans to run for office.

Over the past decade I have worked to fight corruption and incompetence in the state GOP. I opposed the selection of the notorious Jennifer Horn as state chairman, but no one listened. Now her name is always associated with “former Republican Party Chairman.” Uggh. I was a prophet without honor in my own party. But Horn is consistent at least. She and her band of pirates who formed the Lincoln Project are as corrupt and malignant as she was in New Hampshire, where she destroyed the Republican Party. I predicted in 2011 she was a Democrat; her endorsement of Joe Biden comes as no surprise.

Nevertheless, New Hampshire is generally a sensible place. We have low taxes and limited government, although the D’s are always pressuring for more taxes and more government.

Because of your principled conservative stands you are one of my heroes in the Senate. But New Hampshire and Arkansas need to work hard to expand our political horizons to a national audience.

I hope you will decide soon enough to become part of the national conversation.

Andy says in the long run federal and state governments will save more money by avoiding the social pathologies of unemployment than they will by reducing the benefit

Republican U. S. Senate candidate Andy Martin has asked Senator Mitch McConnell to renew the full emergency unemployment benefit. “If Republicans diddle around with 20-30 million people who have lost jobs through no fault of their own, the Republican Party will be decimated in November,” Andy says. “But good politics is also good government. The social costs of cutting off assistance to innocent victims of Chinese Communist treachery will dilute the rest of the GOP message from now to November. I still remember the trauma my brother and I felt when we were little boys and our mom lost her job. We were dependent on her unemployment check. We worried constantly about enough food, money for rent, gasoline. The injury of Coronavirus job losses is emotional and familial as well as financial. Under normal conditions I would be against expanding the deficit and national debt. But in an emergency, you take care of the American people first. Like, ‘America First.’ Are you listening President Trump? Do you want to be reelected?”

Dear Mitch:

I am writing to you from the front lines of the battle to save America and save President Trump. I urge you to renew the $600 Covid unemployment benefit. That program has saved our New Hampshire economy.

Republicans nationally can’t brag about an economic recovery, while cutting themselves off by canceling the benefit that caused the upturn.

I know there has been controversy over whether some people did not go back to work. Reality check: there are always some people who will abuse a government program. In NH, full indoor dining has not recovered; many shops are still closed. Across the nation indoor dining has been blocked. Government has usurped the authority of small business owners by ordering a “greater good” closure of their establishments. In my book, that’s a “taking” under the Constitution. So, don’t be cheap with the “giving.”

The reason the special payments are a boon to citizens is that they create massive spending velocity. I am opposed to a “state aid” relief bill. Guess what? The Covid benefit benefits states and localities through the back door. Everyone benefits. The money is distributed; then it moves at “warp speed” to landlords, who pay taxes to local governments. That’s indirect state aid. The money also goes to utilities, grocery stores and other institutions that have maintained the spending that gave us the good economic news last month. If the economy recovers, the benefits become taxable! It’s a win-win situation.

Right now, the virus is challenging us again. Spending is slowing. If you cut the Covid benefit, I suspect you can kiss the senate majority away. People who are being evicted will tear at the heartstrings of the nation, and motivate people to vote against the president and GOP senate candidates.

I am a balanced budget guy and if I come to Washington, I will vote for spending restraint. But not now. We are in a national emergency that was caused by China. The government-ordered shutdowns of major parts of the economy disrupted tens of millions of Americans. How can leaders complain when the generous benefits they approved limited the stress of economic losses?

Do you know how much stress will be triggered if the benefits are ended? A lot. It’s a losing approach. Society will not recoup the unemployment money in savings because there will be other societal breakdowns that cost more, not less, than continuing the generous benefits in this desperate time .

Here's a tactic for you: stick it to the Democrats. Pass a simple bill which only renews the Covid unemployment benefit. Nothing else in the bill. It will be very popular with all Americans. The president will be a winner and the D’s will be stumped. It’s good politics.
